Compensation Available in Maine Wrongful Death Cases
Maine wrongful death law allows recovery of both economic and non-economic damages. Economic damages cover quantifiable financial losses, including funeral and burial costs, medical expenses tied to the fatal injury or illness, and wages the deceased would have reasonably earned. Non-economic damages compensate for losses like the loss of comfort, society, and companionship and are capped at $1,000,000 under Me. Rev. Stat. tit. 18-C § 2-807, inflation-adjusted for deaths occurring after 2023. In cases involving especially reckless or willful conduct, punitive damages may also be available, capped at $500,000. Separately, a survival claim may allow recovery for the deceased’s conscious pain and suffering before death, with proceeds going to the estate.
